Premises liability is the legal principle that property owners and occupiers have a duty to maintain reasonably safe conditions for people who enter their property. When a hazardous condition on someone’s property causes injury — such as a wet floor, broken staircase, inadequate lighting, icy sidewalk, or unsecured swimming pool — the property owner may be held liable for the resulting damages. In Illinois, the duty of care owed depends on the status of the visitor: invitees (customers, clients) are owed the highest duty, licensees (social guests) are owed a lesser duty, and trespassers are generally owed the least protection, with exceptions for child trespassers under the attractive nuisance doctrine.
