A wrongful death claim is a civil lawsuit filed when a person dies due to the negligence, recklessness, or intentional act of another party. Under the Illinois Wrongful Death Act (740 ILCS 180/), the personal representative of the deceased’s estate may file a lawsuit on behalf of the surviving spouse, children, or next of kin. Recoverable damages include loss of financial support, loss of companionship and society, grief and sorrow, and funeral and medical expenses. Illinois has a two-year statute of limitations for wrongful death claims, running from the date of death.
